Delta 10 THC: Where Is It Legal? State-by-State List

Delta 10 THC is the “new kid on the block” when compared to other cannabinoids like Delta 9 and Delta 8 THC—being as new as Delta 10 THC is, there are a lot of questions about what Delta 10 THC is and whether it is legal or where it is legal. With new cannabinoids come new regulations and laws you need to know.

Let’s have a look at Delta-10 THC, and maybe, we can guide you through all the questions you may have.

Table of Contents:

Delta-10 THC, What Is It?

In the vast world of cannabis, cannabis researchers and scientists have discovered many different types of THC, known as THC isomers or THC analogs. We all know of the popular Delta 9 THC (original THC), Delta-8 THC, which is another THC isomer, and now Delta-10 Tetrahydrocannabinol, also known as Delta-10 THC or D10 THC. Isomers are a set of compounds that have a common identical atomic framework and same molecules but are organized differently. Delta 10 has a fragile molecule when compared to its counterparts Delta-8 and Delta-9 THC. However, D10 THC  is not the same when it comes to the double bond on the 8th carbon ring of its structure; it is located on the 10th. When it comes to the strength of Delta 10, there’s a significant difference, say, compared to Delta 8 because D10’s lighter strength has often been pitched as more of a Sativa leaning cannabinoid, whereas D8 would be more of an Indica.

In the cannabis and hemp plant, you can find trace amounts of Delta 10 THC, around 1% of it in the plant. It is usually processed and made from hemp-derived CBD, like Delta 8 THC.

The Discovery Of Delta 10 THC

Delta 10 THC was actually discovered by accident. The story begins with a California cannabis farm in the county of San Bernadino. The cannabis farm had just bought a batch of outdoor-grown cannabis during the same time the California bushfires were happening. Firefighting planes at the time dropped a fire retardant on the fires, and some of the fire retardants landed on the outdoor cannabis batch that was bought at the time.

In the distillation and extraction process of the outdoor batch from any unwanted contaminants, the farm noticed that strange crystals were beginning to appear. The team on the farm began to absolve the crystals found after the fire and began to study them using a technique called advanced High-Performance Liquid Chromatography (HPLC) technology. The crystals were then sent to a licensed test facility, but even the lab was still stumped as to what it was. After a few months, the farm team named their new discovery Delta 10 THC. That is what leads to the miraculous discovery of D10 THC. It is quite fascinating how some cannabinoids are discovered.

With 50 states in the United States of America, understanding the status of Delta 10 will be different and similar depending on the state. Even though hemp-derived products are federally legal, it does not apply to every state.

The Trump administration, in conjunction with the U.S. Department of Agriculture, signed into legislation the 2018 Farm Bill. The 2018 Farm Bill, aka the Agriculture Improvement Act of 2018, legalized CBD with the content of Delta-9 THC under 0.3% on a dry-weight basis; there is no regulation for Delta 10 directly. The absence of this detail lets Delta 10 live in this grey area of the law that has facilitated the sales to millions of people across the country. The 2018 Farm Bill allows there to be products that are derived from hemp to be on the marketplace.

D10 THC is legal only if it is derived from a hemp plant. Only 100% hemp-derived Delta 10 THC is the form of Delta 10 that is legal. In lamest terms, Delta 10 needs to be made from 100% hemp extracts.  Any D10 product that is derived from Delta 9 THC marijuana is usually considered illegal federally, and that will also depend on the State you reside in.

At ATLRx, we assure you that our Delta 10 THC products are 100% completely hemp-derived and fall under all the guidelines of the 2018 Farm Bill.

Does The FDA Regulate Delta 10 THC?

Currently, the Food and Drug Administration (FDA) does not regulate Delta 10 THC or any other hemp-derived cannabinoids.  However, it is likely that in the future the FDA will draft guidelines for companies to follow. There are currently no standards or rules for manufacturing and producing hemp-derived products, which includes Delta 10.

This also means you must do your due diligence when you decide to buy Delta 10 since there are no standards yet for the products. Shopping with reputable companies like ATLRx will ensure that the Delta 10 you are purchasing will have proper COAs or lab results. This will tell you if you are using quality products made with high-quality components.

Guide For Using Delta 10 THC Legally

What you need to know when purchasing or using Delta 10 legally, here is a simple list to help you figure out what that is:

1. Legal In Your State

Make sure Delta 10 THC products are legal in your state according to the law and regulations. The law and regulations can change at any time, so be sure to be updated with your state.

2. Hemp-Derived Product

Always make sure the Delta 10 products you decide to use are hemp-derived. For Delta 10 THC products to be legal under the 2018 Farm Bill all products must come from 100% hemp plants and comply with hemp having less than 0.3%  Delta 9 THC dry weight standard.

3. Lab Reports and COAs

Be on the lookout for lab reports or COAs (certificates of analysis); this will ensure the safety and quality of the Delta 10 products. The lab reports will show if the product has any pesticides, heavy metals, or solvents and even the dosage and concentration. The quality of products will almost always be a good indicator of the safety of the product.

4. Tolerance And Dosage

Tolerance is created when you use a certain amount of product for a time period. Afterward, your body gets used to the feeling and requires more. Learn how your body functions and figure out the right amount of product that fits your needs. It is up to you as an individual to see what the right amount is right for you.

Can You Buy Delta-10 Online If Your State Is Legal?

Depending on your state’s current laws and regulations, if your state is legal for Delta 10 THC products, you can purchase them online. Most likely, if your state has banned Delta 8 products, Delta 10 products will also be illegal, resulting in you not being able to purchase either of the products online. At ATLRx, we are only able to ship products to states that have Delta 10 as legal in that state.

To buy Delta 10 products from ATLRx, you must be at least 18 years of age and 21 years old for certain products that fall under Georgia’s SB375 legislation. Each and every state in the United States may have a different age requirement, so please be sure to check your state laws.

Can You Fly Or Travel With Delta 10?

According to the 2018 Farm Bill, the Transportation and Security Administration (TSA) in the United States has allowed passengers to carry Delta-10 THC or any other hemp-derived product while flying. Provided it meets the regulations of the 2018 Farm Bill. Depending on the states that have Delta 10 as legal, it is legal to travel with Delta 10 products. For example, Denver Airport in Colorado does not allow Delta 10 THC products on airport premises, so please be aware of which states you plan on traveling to and their laws.

Where To Buy Delta 10 Products Online In Your State

The nice thing about buying Delta 10 THC online is the convenience of it coming straight to your house with no hassle. What Forms Does Delta 10 Come In?

There is a wide variety of different products the D10 THC comes in.  Every type of product that you are used to seeing in the hemp and cannabis market space is available in a Delta 10 variety, from flower to concentrates and many more. You will see something new with the scientific advances in the hemp product market. The universe of Delta 10 is expanding, and a new adventure awaits around every corner.

Why Is Delta 10 More Expensive Than Some Others?

The biggest reason why Delta 10 is more expensive than other THC products is because of the level of difficulty it takes to produce large amounts. Not only is it complicated to produce, but it is also still a baby in comparison to other THC products. There is also a low amount of producers that make Delta 10 products, creating a low, competitive market among producers. The scarcity of Delta 10 is the most significant factor in the price. This is the reason why the prices are higher for everyone trying to buy the Delta 10 distillate to create more products. Like with anything else in this world, the rarer the product, the more it will cost.

How To Stay Informed On The Legality of Delta 10

The best way to stay informed about the legality of Delta 10 THC and its products is to search the internet and watch the news. There are many federal websites online that will state the laws and regulations of cannabis and hemp products. Check your local state government websites, and there should be a category that displays the laws surrounding cannabis and hemp products. The National Conference of State Legislatures (NCLS) is a great website to check on cannabis laws. Continually staying informed will not only keep you safe, but it will keep you out of trouble as well. Stay informed!
