Delta 8 Shatter is federally legal in the United States thanks to the Farm Bill of 2018. This bill was meant to address hemp growers so that the US could become more competitive with the commodity, however—there were some missteps in creating the bill. That misstep took the CBD industry a whole another level, because the legal loophole allowed for Delta-8 THC and all other alternate cannabinoids such as THCv, Delta 10 THC, HHC, and THC-O. They sit in what is called the grey area of the Farm Bill.
The situation hasn’t been solved yet, but there have been states that removed Delta-8 and hemp derivatives off of the Controlled Substance List. Other states have been quick to dismiss delta-8 as a synthetic similar to spice, when that is not the case at all. Delta-8 THC occurs naturally in hemp plants, but to get the quantity that is necessary, it has to be created from CBD. This process is called isomerization, a solvent jumbles the molecular structure and before you know it, the magical process creates delta-8 THC.
