The market has been overrun with legal psychoactive cannabis with a THC level of 0.3% or less ever since the 2018 Farm Bill was passed. That’s the science behind it all, I guess. But this novel and intriguing hemp-derived substance is just getting started. What advantages can HHC offer? How is HHC produced? Most importantly, does HHC cause you to feel high? It’s critical to be aware of these details as with any novel cannabinoids.
This is the question we love to ask whenever a new cannabinoid is introduced. Is HHC illegal? With the caveat that it might be in a gray area and that there’s always some dispute on this one, the answer to that is a resounding yes due to the Farm Bill and our friends in Congress. But generally speaking, it’s difficult to refute that statement.
So let’s refer to it as a legal gray area, but the reality is a little bit easier. In accordance with the 2018 Farm Bill, the Drug Enforcement Administration (DEA) published an interim regulation laying out the legal limitations on cannabis and its components. It declared that “all tetrahydrocannabinols generated synthetically remain Schedule I controlled substances.”
As a result, whether HHC is a synthetic or a natural substance largely determines its legality. The majority would contend—and justifiably so—that it is authentic.

Others disagree, though. Other experts are more skeptical, as Leafly noted. In accordance with the Federal Analogue Act, any substance that is similar to a Schedule I drug-in this case, conventional THC-would be considered a Schedule I drug in its own right.
