So a little history of how THCO was discovered started between 1949 and 1975. The United States Army was conducting experiments in the Edgewood Arsenal Experiments. They quickly discovered that THC-O had significantly different strengths from regular THC. During this time period, the researchers were investigating this as a possible non-lethal incapacitating agent, which is highly unethical and basically chemical warfare.

Around 30 years later, THC-O was rediscovered in Jacksonville, FL in a lab by using the soxhlet extraction method, which is the process of using acetic anhydride. DEO researchers began to focus on the derivation process of THC-O. The questionable process that the DEO researchers compared this to methods used for opiate drugs like heroin and morphine. The DEO researchers started THC-O on a bad foot, but with time and improvement in scientific research, the public perception of THC-O has begun to change for the better.

In 2018 the Trump administration, in conjunction with the U.S. Department of Agriculture, signed into legislation the 2018 Farm Bill. The 2018 Farm Bill, also known as the Agriculture Improvement Act of 2018, legalized all hemp products with the content of Delta-9 THC under 0.3% on a dry-weight basis. THC-O is only legal if it is derived from hemp, according to the 2018 Farm Bill. While THC-O is an analog of THC, because it is derived from hemp, it is considered legal. All products that are 100% hemp derived are considered legal federally.

Some state legislatures have started to restrict hemp-derived products by regulating and passing bans or only allowing sales in state-controlled dispensaries. What is quite surprising is that it is usually the legal cannabis industry that pushes for the laws that restrict sales of these hemp products, which compete with marijuana and other marijuana-related products sold in licensed dispensaries.

Will THC-O Fail A Drug Test?

Since THC-O is an analog of THC, it will most likely cause you to test positive (fail the drug test) on a drug test. Drug tests usually cannot tell the difference between an analog or THC. As an acetate ester form of THC, it seems likely that a drug test will test positive for the THC metabolites in the urine, blood, or hair of the user. THCO is federally legal according to the 2018 Farm Bill, while Delta 9 THC is still considered federally legal. THC-O is seen as hemp derived cannabinoid, which gives THC-O-acetate its legal status. Delta 9 THC or marijuana is only legal in certain states but is not seen as federally legal. However, if the Delta 9 THC is hemp-derived, it is considered federally legal. For either to be federally legal, it must be 100% hemp-derived.
